Terms of Purchase

These Terms of Purchase apply to every purchase made through Studio Kiku Academy at academy.studiokiku.com.

The seller is Studio Kiku LLC, doing business as Studio Kiku Academy ("Studio Kiku," "we," "us," or "our").

By completing a purchase, you confirm that you have read and agree to these Terms of Purchase, the Refund Policy, the Privacy Policy, and the Course Access Policy. Together, these documents form the agreement between you and Studio Kiku concerning your purchase.

If any part of this agreement conflicts with a consumer right that cannot legally be waived, the applicable law will prevail.

What You Are Purchasing

Your purchase grants one person a limited, personal, non-exclusive, non-transferable, and revocable licence to access the purchased online course or course bundle.

Unless otherwise stated on the course page or at checkout, access is provided for one year from the purchase date.

You are purchasing access to educational content. You are not purchasing ownership of the course or its videos, text, photographs, illustrations, downloads, forms, protocols, or other materials.

The rules governing your use of the course and Academy platform are explained in the Course Access Policy.

Educational Purpose and Professional Responsibility

Studio Kiku Academy courses are provided for education and professional development. They do not replace hands-on equipment training, supervised clinical training, manufacturer training, medical education, professional judgment, or advice from a qualified legal, medical, insurance, or regulatory professional.

Completing a course or receiving a certificate does not:

  • grant a professional licence, designation, accreditation, or government authorization;
  • authorize you to purchase, operate, or supervise a laser or other medical or aesthetic device;
  • establish that you are legally permitted to provide a particular treatment;
  • qualify you for insurance, medical oversight, employment, or professional registration;
  • create an employment, franchise, agency, partnership, or professional relationship with Studio Kiku; or
  • guarantee any clinical, employment, business, financial, or educational outcome.

Laws governing laser treatments, tattoo removal, cosmetic procedures, medical devices, infection prevention, advertising, informed consent, recordkeeping, medical oversight, and professional scopes of practice vary by jurisdiction and may change.

You are responsible for determining and complying with all laws, licensing requirements, scopes of practice, facility requirements, medical-director or physician-oversight requirements, insurance conditions, manufacturer instructions, and professional standards that apply to you.

You must not perform a procedure unless you are legally authorized, appropriately trained, properly insured, and working within your permitted scope of practice.

Eligibility

You must be at least 18 years old and legally capable of entering into a binding agreement to purchase a course unless Studio Kiku expressly permits enrollment by a minor with the documented consent of a parent or legal guardian.

You agree to provide complete and accurate account, billing, and purchase information.

Pricing, Currency, Taxes, and Payment

The course price, currency, applicable taxes, and any additional charges will be displayed before you complete your purchase.

Payments are processed through Stripe or another payment processor identified at checkout. Applicable taxes may be calculated based on your billing information and the legal requirements that apply to the transaction.

The total amount displayed and accepted at checkout is the amount you authorize us and our payment processor to charge.

Promotional codes, discounts, and special offers must be applied before payment. They cannot ordinarily be applied to a completed purchase and may be subject to separate eligibility requirements, expiry dates, and restrictions.

Electronic Delivery

Course access is delivered electronically to the account and email address associated with your purchase.

Access will normally be available shortly after successful payment. If you do not receive access, contact training@studiokiku.com.

You are responsible for having a compatible device, a supported browser, a reliable internet connection, and any other technology described on the course page.

Team Seat Purchases

A team purchase provides the purchaser with the fixed number of course seats identified at checkout.

The purchaser may invite one individual per seat using that individual's email address. Each seat holder must create their own account and personally accept the applicable terms and policies.

Each seat is personal to the invited individual and cannot be shared. Once a seat has been claimed and the course has been accessed, it cannot ordinarily be reassigned. Studio Kiku may permit a correction or reassignment in reasonable circumstances.

The team purchaser may see limited administrative information, including:

  • the invited person's name or email address;
  • whether the invitation has been claimed; and
  • whether the course has been completed.

The purchaser will not receive access to quiz answers, private communications, playback history, or other detailed learning information unless disclosure is permitted under the Privacy Policy or required by law.

The purchaser is responsible for informing each invited person that this limited administrative information may be visible to the purchaser.

Renewals

Course access does not renew automatically.

Where renewal is available, you may purchase an additional year of access at the renewal price offered at that time.

Renewing before expiry extends access from the existing expiry date. Renewing after expiry restores access beginning on the renewal date.

Studio Kiku does not guarantee that a course or renewal option will remain available indefinitely.

Certificates of Completion

If a course offers a certificate, one certificate may be issued to the registered learner after all required course components have been completed.

A certificate confirms completion of the identified Studio Kiku Academy course. It is not a professional licence, independent accreditation, government credential, or authorization to practise.

Certificates may include a verification link. The information displayed through that link is explained in the Privacy Policy.

Studio Kiku may withhold or revoke a certificate obtained through account sharing, misrepresentation, academic dishonesty, fraudulent activity, or a material violation of the Course Access Policy.

Certificates may not be altered, transferred, reproduced deceptively, or used to misrepresent the learner's qualifications.

Refunds and Cancellations

Refund and cancellation eligibility is governed by the Refund Policy.

Nothing in these terms or the Refund Policy limits a cancellation, refund, chargeback, or other consumer right that cannot legally be waived.

Course Updates and Availability

Studio Kiku may correct errors, update lessons, replace content, modify assessments, or make reasonable changes to maintain the course's accuracy, safety, legal compliance, or quality.

Course information may become outdated as laws, research, technology, clinical practices, and manufacturer instructions change. You are responsible for independently confirming that information remains current before relying on it professionally.

Studio Kiku may temporarily interrupt access for maintenance, security, technical problems, or circumstances outside our reasonable control.

If Studio Kiku permanently discontinues a purchased course before the end of the applicable access period, we may provide substantially similar content, access to another course, an extension, or an appropriate refund, subject to applicable law.

Suspension or Termination

Studio Kiku may suspend or revoke access if you materially violate these terms or the Course Access Policy, misuse the platform or course content, engage in fraudulent or unlawful activity, or create a material security risk.

Where reasonably appropriate, we may provide notice and an opportunity to correct the violation. Immediate suspension may be necessary for serious, repeated, fraudulent, unlawful, or security-related conduct.

Refund eligibility following suspension or revocation is governed by the Refund Policy.

Disclaimers

To the fullest extent permitted by law, Studio Kiku Academy, its courses, and its course materials are provided on an "as is" and "as available" basis.

Studio Kiku does not guarantee:

  • uninterrupted or error-free access;
  • that every statement or course resource will remain current;
  • compatibility with every device or browser;
  • acceptance of a certificate by an employer, regulator, insurer, or professional association;
  • compliance with the laws of every jurisdiction;
  • eligibility to perform any treatment; or
  • any particular clinical, employment, business, or financial outcome.

Nothing in these terms excludes a warranty, remedy, or consumer protection that cannot legally be excluded.

Limitation of Liability

To the fullest extent permitted by law, Studio Kiku LLC and its owners, officers, employees, instructors, contractors, licensors, and service providers will not be liable for indirect, incidental, special, punitive, exemplary, or consequential losses arising from your purchase or use of the Academy, including lost profits, lost revenue, lost business opportunities, lost data, or reputational harm.

To the fullest extent permitted by law, Studio Kiku's total liability arising from a particular purchase will not exceed the amount you paid Studio Kiku for that purchase.

These limitations do not apply to fraud, wilful misconduct, gross negligence, personal injury caused by negligence where liability cannot be excluded, or any other liability or consumer remedy that applicable law does not permit us to limit.

Third-Party Services

Studio Kiku Academy relies on third-party providers for services such as payments, hosting, account management, video delivery, email, error monitoring, and certificate verification.

Your use of certain third-party services may also be subject to the provider's terms and privacy practices.

Links to third-party websites or resources are provided for convenience. Studio Kiku does not control or guarantee all information found on those websites.

Governing Law

These terms are governed by the laws of the State of Florida and applicable federal laws of the United States, without regard to conflict-of-law principles.

This provision does not deprive a consumer of any mandatory protection provided by the laws of the consumer's province, territory, state, or country of residence.

Changes to These Terms

Studio Kiku may update these terms for future purchases.

The version accepted at checkout governs that purchase unless a later change is required by law or separately accepted by you.

A renewal or new purchase may be governed by the version presented and accepted at that time.

General Provisions

If any provision of these terms is found to be unenforceable, it will be limited only to the extent necessary, and the remaining provisions will continue in effect.

Our failure to enforce a provision does not waive our right to enforce it later.

You may not transfer your rights under these terms without our written consent.

These Terms of Purchase, together with the Refund Policy, Privacy Policy, Course Access Policy, and information displayed at checkout, form the complete agreement concerning your purchase.
